Terms and conditions for competitions

1. Scope

These terms and conditions of participation apply to all competitions conducted by UWU GmbH, Schnellerstraße 60, 12439 Berlin (hereinafter referred to as „UWU“). By participating in the competition, the participant agrees to these terms and conditions.

It the competition takes place on a social media or video platform such as Instagram, Facebook, Youtube, TikTok or other social media or video platforms, it is not connected with these platforms. The competition is in no way sponsored, endorsed or administered by, or associated with, the platform. All information in this competition is provided solely by UWU.

2. Participation

  1. Any participant must be a natural person participating in his or her own name. The minimum age is 18 years. Participants who have already reached the age of 16 but are not yet legally adults may only participate in the competition with the prior consent of their legal guardians.
  2. UWU reserves the right to exclude participants who violate these terms and conditions or who gain or intend to gain an advantage over other participants by improperly influencing or manipulating the competition. In such cases, UWU may also subsequently exclude participants from the competition withdraw prizes and reclaim them.
  3. Participation is only possible within the stated participation period. Each participant may only participate once in an identical competition unless otherwise specified in the contest announcement.
  4. Employees of UWU, as well as employees of other companies participating in this competition and their direct relatives are excluded from participation in the competition.

3. Procedure

  1. The requirements for participation are based on the respective description of the competition in the competition announcement. Each competition has a participation period. Participation is excluded after the end of this period. To determine the winner, all participants who have fulfilled the requirements for participation during the participation period will be taken into account. In case the competition takes place on social media channels such as Instagram, this may include following the company account, liking a post and/or commenting on the post. Immediately after the end of the participation period, the winner or winners will be determined on a random basis.
  2. A cash payment of the prize is excluded. The prize is not transferable.

4. Notification oft he winner(s)

  1. The winner(s) will be notified by UWU by email, direct message on social media or by other electronic means. The winner hast wo weeks to respond to the prize notification by informing UWU whether he/she accepts the prize and, if applicable, to provide a delivery address. If the winner does not respond to the prize notification within two weeks, refuses the prize or does not provide required information (e.g. a delivery address), the possibility of accepting the prize expires and the company may determine a new winner.
  2. The participant is responsible for the correctness of his/her contact details which he/she provided to UWU (e.g. incorrect email address). UWU is not obliged to determine the correct data. Any disadvantages shall be borne by the participant.
  3. If the identity and contact details of the winner UWU are known, for example, in the case of a win as part of an order in the UWU online shop, a separate notification of the winners may be omitted. In this case, the winner receives their prize directly.

5. Termination, adjustment or modification of the competition

UWU is entitled to terminate, adjust or modify the competition at any time without prior notice and without stating reasons, including premature termination, if proper implementation of the competition is not possible for technical or legal reasons without taking appropriate measures. Changes in favor of the participants are always possible.

6. Applicable law

The law of the Federal Republic of Germany shall apply to all legal relationships between the parties. In case an EU consumer (§ 13 German Civil Code – BGB) is involved, this choice of law shall only apply to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his habitual residence.

If the competition is organized via a social media or video platform, e.g. Instagram, YouTube, TikTok or Facebook, UWU is jointly responsible for data processing with the respective platform operators according to Art. 26 GDPR.

Processing of personal data in the context of competitions

We process your personal data for the proper execution and handling of the competition, in particular for determining the winner and shipping of the prize.

Your name or profile name will be collected and stored in order to conduct the competition. If you are picked as the winner, we also need your address in order to send the prize. We pass this data on to our shipping company. Your data will not be passed on to other third parties.

The legal basis for this processing is Art. 6 para. 1 lit. b GDPR (implementation of pre-contractual measures and fulfillment of a contract).

If we wish to publish the name or profile name of one or all winners on our website, profile or fan page or our online store, we will only do so after prior consultation and with the prior consent of the winner(s) according to Art. 6 para. 1 lit. a GDPR.

Duration of storage

After the end of the competition, your data will be deleted no later than three months, unless we have your consent for further processing (e.g. for newsletter distribution) and/or we have a legitimate interest. We do not delete any participation actions such as comments and likes from our social media accounts. However, you are free to delete these yourself at any time.

Data subject rights

According to the GDPR, you have the right to to request information about the data stored by us (Art. 15 GDPR), to request the correction of incorrect information (Art. 16 GDPR), to request the deletion of your data (Art. 17 GDPR), and to restrict the processing of data (Art. 18 GDPR). Furthermore, you have the right of notification (Art. 19 GDPR), data portability (Art. 20 GDPR), objection to data processing (Art. 21 GDPR), revocation of your consent (Art. 7 para. 3 GDPR) and complaint to the supervisory authority (Art. 77 GDPR).
